Reporting to the Supervisor of Board Services, the Privacy Advisor is responsible for the daily compliance and privacy duties for the TVDSB. This includes legislative tracking, reporting, and coordinating training and resources at various levels to ensure adherence to board procedures and privacy legislative standards. The Advisor acts as the subject-matter expert for all staff and the public on compliance and privacy-related questions. KEY RESPONSIBILITIES:
- Oversee breaches and privacy for the board, acting as subject matter expert on the interpretation, implementation, and adherence to breach and privacy-related matters (legislative/board processes) in alignment with legislation and best practice.
- Investigate suspected and confirmed breaches and implement corrective strategies and additional training/support as needed.
- Address any privacy concerns voiced by students, parents, employees, and members of the public.
- Sit on committees (where appropriate) to speak on behalf of related compliance, breach, PIA or/and privacy matters.
- Conduct Privacy Impact Assessments (PIAs) for any apps/websites/software that may be used by staff/teachers/students/public.
- Update procedures and policies, as well as resources, as required.
- Coordinate with employees at all levels of the organization to address the collection, use, and disclosure of personal information.
- Report and respond to the Information and Privacy Commissioner of Ontario (IPC) regarding breaches and privacy complaints.
- Write reports and recommendations to senior management.
- Implement action items from Privacy Audits and/or IPC decisions; and
- Process and respond to Freedom of Information (FOI) requests under the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA), as needed
- Monitor and proactively assess compliance with privacy legislation, board policies, and procedures, including conducting regular audits, risk assessments, and reporting findings to senior leadership.
WORK PERFORMED:
- Ensure compliance through strong governance frameworks by developing, implementing, and maintaining policies, standards, and oversight mechanisms that support accountability and transparency.
- Act as the subject matter expert for day-to-day compliance and privacy questions from employees and members of the public, including questions of consent, access, retention, disposition, etc.
- Complete Privacy Impact Assessments on any applications (software, websites, etc.) that the board may consider implementing.
- Present to employees on privacy-related topics.
- Create resources for mandatory training related to compliance, records, breach/reporting, FOI, and other privacy-related topics.
- Respond to privacy breaches and incidents according to TVDSB’s Breach Protocol Procedure, reporting to the IPC when required.
- Work on large-scale projects involving multiple departments/board-wide initiatives.
- Work on FOI requests when a significant volume has been received.
- Other projects or duties as assigned.
- Knowledge of provincial legislation regarding Freedom of Information, privacy, and access laws, including MFIPPA, and the Enhancing Digital Security and Trust Act (EDSTA)
- Possess group facilitation and presentation skills.
- Proficient in computer systems such as Outlook 365, MS Office Suite, Teams, etc.
- Excellent interpersonal skills with effective communication skills, both orally and in writing.
- Ability to work both independently and part of a team.
- Strong problem-making skills and the ability to make decisions.
- Ability to work with and assist fellow employees and members of the community.
- Ability to coordinate multiple large-scale projects.
- At least 5 (five) years of experience working within the public sector, preferably in a records, compliance, privacy or related-subject role.
- Completion of a two (2) year Post-Secondary program in Business, Administration or equivalent.
- Completion of the Information Management, Privacy, and Access certificate is an asset; or are willing to obtain the Information Management, Privacy, and Access certificate.
- Supervisory experience and experience in coordinating large scale projects is an asset.
